USER AND MEMBERSHIP AGREEMENT

The general terms of use of the site, general rules and legal responsibilities, and the User and Membership Agreement, which includes the contract terms, rules and legal responsibilities stated below, should be read before using www.yunkajewelry.com. If these terms are not suitable for you, please do not use the website.

To establish this user and membership agreement, simply enter the requested Member information and the password you will choose, and click the button after giving the specified approvals and/or permissions. We especially request that you enter your name, email address/mobile phone number, and other required information correctly, completely, and without errors; please correct any errors you notice. By entering the information requested in the Membership Information section on our Site and approving this Agreement, the Member is deemed to have seen, read, reviewed, and understood the information, terms, and conditions regarding personal data processing, membership, and customer service on our Site and in our stores.

Yunka Jewelry reserves the right to change, reorganize, or discontinue any services, products, terms of use, and information offered on this site without prior notice. Changes will take effect on the date of publication on the site. Yunka Jewelry advises its members and users to visit the legal notice page each time they access the site.

1. PARTIES

When entering into a membership agreement via the internet at www.yunkajewelry.com ("Site"), the party you are entering into this agreement with is Yunka Jewelry ("Yunka Jewelry").

A user is anyone who visits the Yunka Jewelry website, whether or not they make a purchase.

A Member is any natural or legal person who wishes to purchase products from Yunka Jewelry, completes the membership form, and whose membership is approved and accepted by Yunka Jewelry. They will be referred to as "MEMBER" in this agreement. Individuals who are 18 years of age or older can become members by completing the relevant membership form on the SITE with their real identity information. Companies (Sole Proprietorships and Partnerships), Collective Companies, Ordinary Limited Partnerships, Limited Partnerships with Capital Divided into Shares, Limited Liability Companies, Joint Stock Companies, Cooperatives, and other institutions can become members by completing the relevant membership form on the SITE with their legal information and their legal representative who is 18 years of age or older, and can conduct transactions on behalf of their institution. The "Member name" is unique to each member, and the same "Member name" will not be assigned to two different MEMBERS.

2. SUBJECT OF THE CONTRACT

The services that Yunka Jewelry will offer through its website generally consist of electronic commerce as defined in consumer law legislation.

Yunka Jewelry's services provided through the site include, but are not limited to, the delivery of Yunka Jewelry products sold at www.yunkajewelry.com to the User or Member by a shipping company on behalf of Yunka Jewelry, after payment of the total price including taxes and other legal obligations.

3. TERMS OF USE

3.1. Persons under the age of 18 cannot make purchases from our website or mobile application. By accessing and/or registering on the site, the individual declares and accepts that they are over 18 years of age.

3.2. By making a purchase, you acknowledge that this is for personal use and not for resale.

3.3. You are not required to register to make purchases. However, to benefit from various advantages and to make your future purchases even faster, you must register.

3.4. The Member acknowledges that the address, email address, landline and mobile phone numbers, and other contact information provided in the membership form or subsequently updated by the Member are accurate under the law, and that the Member is obligated to fully and immediately compensate Yunka Jewelry for all damages incurred due to the inaccuracy of this information. The Member also acknowledges that Yunka Jewelry has the right to contact the Member via letter, email, SMS, telephone call, and other means for communication, marketing, notification, and other purposes based on the information provided, and that, unless a written notice to the contrary is given, by approving this membership agreement, Yunka Jewelry may contact the Member for the purpose of carrying out the aforementioned communication activities, use their information within the scope of its own marketing activities, and share it with third parties within the framework of the Personal Data Protection Law.

3.5. The prices and sales conditions applied to all products offered for sale on the website are valid only on the website.

3.6. Yunka Jewelry is not responsible for price and content errors resulting from typesetting and system errors, and reserves the right to cancel or not fulfill orders that are incorrectly displayed.

3.7. The trademarks, trade names, titles, logos, graphics, designs, visuals, overall appearance, texts, and all other materials and technical data used on the website and its extensions, if any, are the property of https://www.yunkajewelry.com and its affiliated company, Yunka Jewelry, and are under legal protection. The text and graphic files presented on this site are protected by copyright and/or registered trademark laws or by any other means as registered designs belonging to https://www.yunkajewelry.com. Therefore, no element, including any text or visual material listed above, on the website and its extensions, if any, may be used without prior permission. No material or functionality on this site may be published, copied, reproduced, modified, re-edited, translated into another license, sent by mail, uploaded to a computer and used for any purpose whatsoever, linked to, or used on other websites without the permission of Yunka Jewelry. All rights not listed herein are reserved, and in the event of any breach of these rights, Yunka Jewelry reserves the right to pursue all legal and criminal remedies.

3.8. Yunka Jewelry shall not be liable in any way for any direct and/or indirect damages that may arise for any reason whatsoever as a result of accessing the website and its extensions (if any), and using the information and other data contained on the site.

3.9. If the website provides links to websites not owned by Yunka Jewelry, Yunka Jewelry shall not be held liable in any way, legally, criminally, administratively, or otherwise, for the content of these websites and/or the links they contain. The risks arising from accessing these linked websites are entirely the responsibility of the Members and Users.

3.10. Yunka Jewelry is not responsible for any interruption, deletion, loss, delay in processing, computer virus infection, unauthorized access to records, theft, alteration or misuse of records for any reason whatsoever.

3.11. The processing date for bank transfer/EFT orders is the date the payment is received in our bank accounts, not the date the order was placed.

3.12. For bank transfer/EFT orders, orders for which payment is not received within 72 hours and we are not notified of the transaction by clicking the "I have made a bank transfer/EFT" button and/or via email will be cancelled.

3.13. Yunka Jewelry does not keep stock of all products offered for sale on its website, www.yunkajewelry.com. Ordered products are manufactured when deemed necessary. However, for various reasons, it may not be possible to manufacture ordered products that are not in stock. In this case, the person who placed the order will be informed via email or telephone, and the amount paid for the product will be refunded in full, without any penalties, interest, etc., to the credit card if the order was placed by credit card, or to the bank account if the order was placed by bank transfer/EFT.

3.14. If it is determined that incorrect, incomplete, misleading information or statements, or information and statements that violate general moral principles, public order, and Turkish law have been entered into our site, or if any activity threatening the security of the site and operating system has been undertaken, or if attempts have been made to alter or delete information on the site, or similar situations have occurred, the Member's and User's access to our site may be blocked. Yunka Jewelry reserves all its legal and criminal rights, including the right to unilaterally terminate the contract, against individuals and institutions involved in such activities.

3.15. Members are not permitted to share information such as their membership name and password with third parties or organizations, or to access and use the information of other members. The member is responsible for any damages arising from their actions contrary to this provision. The member will be liable for all legal, administrative, and criminal liabilities arising from such uses.

4. OBLIGATIONS

4.1. Members and Users declare, accept, and undertake to comply with the notifications that Yunka Jewelry will publish regarding the services it provides while using the site, and with all legal regulations, primarily the Turkish Penal Code, the Turkish Code of Obligations, the Turkish Civil Code, the Turkish Commercial Code, the Law on Intellectual and Artistic Works, and the Trademark and Patent Legislation, and that in case of non-compliance, all legal, criminal, and administrative responsibility will belong to the Member and User.

4.2. Members and Users may not use the website for any purpose that is contrary to general morality, disrupts public order, disturbs others, or is against the law.

4.3. If Yunka Jewelry determines that its Members and Users are not complying with the obligations listed in Article 4.1 and/or the general rules stated on the site, even if not explicitly listed herein, it reserves the right to temporarily or permanently block the Member or User's access to the site and/or close their account, and to unilaterally terminate the agreement.

4.4. The Member and User declare, accept, and undertake to compensate Yunka Jewelry for any and all damages incurred as a result of their actions contrary to the obligations undertaken in this agreement, and that Yunka Jewelry has the right to recourse against the Member and User for any compensation and/or administrative and judicial fines that Yunka Jewelry may be obliged to pay to public institutions and/or third parties due to the Member and User's breach of contract.

4.5. If a member wishes to cancel their membership, they must notify this request by email to info@yunkajewelry.com or by phone at 08508409499. If the membership is cancelled, the member's access to the site will be revoked.

4.6. Users and Members are solely responsible for keeping all correspondence with Yunka Jewelry safe, and Yunka Jewelry cannot be held liable in any way for the deletion and/or loss of such correspondence.

4.7. In the event that a member terminates their account, Yunka Jewelry reserves the right to delete/not delete, and to share/not share, account information with third parties, in accordance with the Personal Data Protection Law. In this case, the member has no right to claim any rights or compensation from Yunka Jewelry under any circumstances.

4.8. Members are solely responsible for their own relationships with other members, and members may not engage in activities or transactions that prevent or hinder the use of the site by other members and/or non-member Users (spam, viruses, Trojan horses, etc.). Otherwise, Yunka Jewelry reserves the right to disclose the members' personal information, terminate their membership accounts, and demand compensation for any damages incurred and/or to be incurred, in the event of a criminal complaint and a request for investigation from official authorities.

4.9. Although Yunka Jewelry has taken measures to ensure that its website is free from viruses and other malicious software, Members are required to provide their own antivirus software for ultimate protection. Members are responsible for all damages that may occur to their own software and operating systems as a result of accessing the website or using the mobile application.

4.10. Yunka Jewelry reserves the right to unilaterally modify the terms of this agreement without prior notice, to permanently/temporarily suspend the services provided to Members and Users, and to change their content. If Yunka Jewelry makes any changes to these terms, it will publish the updated information on the website.

4.11. Yunka Jewelry may disclose its members' personal information when legally required to do so and/or when necessary to protect and defend Yunka Jewelry's rights and property, in accordance with the principles of honesty. To read about the measures we take to protect our users' personal information and privacy and our general policy on this matter, please read the "Privacy Policy" section.

4.12. The opinions and views expressed and used by Members and Users on the website are entirely their personal views and are binding only on the person expressing them. Yunka Jewelry is not liable for any damages that third parties may suffer due to the opinions and views expressed by these individuals, or for any damages that its Members and Users may suffer due to the opinions and views expressed by third parties.

4.13. If it is determined that members and users are engaging in activities contrary to the terms of this agreement, Yunka Jewelry may terminate their contracts unilaterally without prior notice.

4.14. The parties acknowledge and declare that all computer records belonging to Yunka Jewelry shall be considered as the sole and exclusive evidence, in accordance with Article 193 of the Code of Civil Procedure, and that said records constitute an evidentiary agreement.

5. EFFECTIVE DATE

By completing and approving this membership form, or by using this site to obtain services or place orders, the Member declares, accepts, and undertakes to comply with this agreement. This agreement may be terminated unilaterally by Yunka Jewelry without any prior notice upon the termination of membership or the occurrence of any of the termination events listed in this agreement.

6. COMPETENT COURT

The Istanbul Anatolian Courts and Enforcement Offices are authorized to resolve any disputes arising from the implementation of this agreement.

7. NOTIFICATION

7.1. The email address provided by the Member to Yunka Jewelry shall be considered the legal email address for all notifications related to this agreement. Any notification sent to the Member using this email address shall be deemed to have been received by the Member one day after the email was sent.

7.2. The parties agree that unless they notify the other party in writing of any changes to their current email addresses within 5 (five) days, requests made to the old email addresses will be considered valid and deemed to have been received by them.

The member declares, accepts, and undertakes that they have read, understood, and accepted all the terms of this membership agreement, that they confirm the accuracy of the information they have provided, and that they consent to receiving all commercial content sent to them after this confirmation.
